The phone has "Latitude" on it that is supposed to share your location with other Latitude users. There are other sharing location Apps out there. But I do not believe he would not know this was on. It is also a big battery strain to keep GPS on all the time. It sounds like he has been, shall I say, savvy in the past. Perhaps you can compromise. Make him turn tracking on when he goes out at night and if you pop in to see where he is and GPS is not on or he is not where he is supposed to be, he is busted.

If you are on verizon, there is the chaperone app you can use. It comes with a monthly fee though.
I use one called DroidSecureMe. Its free in the market. I only used it once so I cant comment too much on it but it seemed to work good.
Why not just use Latitude?
Sounds like something my parents would try to do, but they don't have smart phones, and there's no way they could do it without me knowing.
Personally, I think you're going the wrong route with your parenting by spying on your kid. That's one of the only things I hate about technology today. When you were a kid, parents were forced to have a little faith in you. Nowadays, there's no end to how snoopy parents can be. Just let him enjoy his life and learn some things on his own.
