Micro$oft signs patent agreement with HTC

Microsoft Corp. and HTC Corp. have signed a patent agreement that provides broad coverage under Microsoft’s patent portfolio for HTC’s mobile phones running the Android mobile platform. Under the terms of the agreement, Microsoft will receive royalties from HTC.

The agreement expands HTC’s long-standing business relationship with Microsoft.

“HTC and Microsoft have a long history of technical and commercial collaboration, and today’s agreement is an example of how industry leaders can reach commercial arrangements that address intellectual property,” said Horacio Gutierrez, corporate vice president and deputy general counsel of Intellectual Property and Licensing at Microsoft. “We are pleased to continue our collaboration with HTC.”

What choice do they have. With Apple taking them head-on, I guess they don't want MS at their backs too!

This is a move in a business chess game...HTC now has a good-faith agreement with M$, allowing access to it's IP ..sort of a 'blessing' if you will (aka 'we won't do what Apple is doing to you'). This permission costs HTC a small percentage of it's sales. This, imho, strengthens HTC's hand in Apple litigation, with an eye towards forming a similar deal with Apple. Indeed, I suspect some of this came about from failure of prior discussions with Apple...companies of all sizes typically don't launch a legal assault publically unless they played out their hand without getting the results they sought. Apple's asking price was just dealt a blow.
