Well after looking into this there are 2 ways to do it.

#1 Delete or rename /system/apps/TetheringManager2.apk
#2 Making the Application not runable. I did this via System Tuner application

You need to be rooted for both

For #1
You will need adb
run the following commands
adb remount
adb shell
cd /system/apps
mv TetheringManager2.apk TetheringManager2.ap

For #2
Go into System Tuner
Click on Apps
Click on System
Scroll down to TetheringManager and click on it, then select Freeze Application

That is it, you should be able to wifi tether now.
